    Re: Is this legal??

So the credit card company wrote to you to see if you'd had payment?

You haven't, so write and tell them you haven't. Attach a typed letter to an email or fax one to them.

    Re: Is this legal??

Gentle persuasion has to be very carefully done. There is a law against demanding money with menaces
    Maybe. But.......................
a). If this is a business i SERIOUSLY doubt they would report it.
b). They deserve a little visit and they are probably expecting it.
c). It costs nothing (if you do it yourself) and if someone does it for you its only £50ish
d). It the fun way to get results.
e). Its the ONLY sure-fire way to get the cash back

the only surefire way to get the cash back is to follow the law. Not send "the boys" around to "pay a little visit" or other slang terms.

You've had a court judgment rules in your favour. Follow the process through.

So what does come next? Presumably on Friday I phone the courts to tell them about the breach of judgement? Tried phoning him today, and he refuses to speak to me, demanding that we only communicate in writing.

It's so frustrating, tempted to go to the local papers to see if they want a "human interest" story.

The only way to get the money back, if the defendant refuses to pay again, is to hire bailiffs at your own costs to seize goods to the value of the refund due.

Unfortunately, when things get to this stage, it often ends up costing more money thanyou are due in the first place.
Please stop talking complete tosh. It seems to be a habit of yours to comment authoritatively on things you clearly know nothing about. Funny, since you seem to rip into others for doing exactioly that.

I have experience of the county court getting money off people. I simply filled in some paperwork for the court, paid £40 for the court appointed bailiff to pay the idiot a visit and shortly therafter recieved appx £3,000 for my troubles. The costs for the bailiff was added to the amount owed to me and taken from the defendant when they took the rest of the money he owed me.
Why don't you stick to advising people on power supplies or something

Visit the county court. Get the paperwork for "What do I do is the defendant doesn't pay"
You have lots of options some of which involve freezing all of the defendants bank accounts (a garnishee order) getting bailiffs involved or other fun like that.

    Re: Is this legal??

don't communitcate with the guy, don't run news paper articles, don't do anything petty.

you have gone to court - you have won. The court has collections procedures, go to the court and start them.

This will take longer to get your money but you will not pay a thing and get your money in full. The longer he takes the more he pays.

    eg: he owes you £1000
Court sends an order for £1000 baylif adds £100 collection fee and £50 costs so he now owes £1150 - he doesn't pay - the baylifs/courts progress it for you, each baylif visit costs £50, the admin fee will go up so the longer he holds out, the more skint he'll be, to the end where the baylifs come around and just take stuff - sell it at auction cheap as chips and you get your money.
    It is Inevitable.....

I wondered when you would emerge. Took longer than usual aswell.
As for clearly knowing nothing....how would you know? You only ever post to flame and never read any posts before doing so.
I really shouldnt respond to you as you are clearly not too bright but i can't help myself. You are that weird.
    (Sorry admins...he/she/it is)

Why don't you stick to advising people on power supplies or something
I rest my case. You arent even good at sarcasm. I think your 'thanks' count shows how little you really know. Over 1500 posts and few of any use to anyone...Says it all. I just clicked your 'Thank' button btw as i dont want you to feel completely pointless.

I have experience of the county court getting money off people. By the sounds of it, it is you thats know little or nothing. If this is through a small claims court, the bailiff charges are definitely not added onto the original amount.
But only IF ITS A SMALL CLAIMS COURT issue.
What are you on about with a COURT APPOINTED BAILIFF??? They will not act on your behalf in cases like these. I would have thought with your obvious extensive knowledge you would know this
You are required to sort your own bailiff out....

    Now.....please continue
