is it illegal to delete the evidence to a potential crime?
thankfully i doubt they have burnt the HDD's so therefore anyone with some deep recovery tools would be able to prove their existance on this machinery...

I doubt they have deleted them properly, I suspect they are still sat in the trash can or a quick disc recovery tool could find them.
I don't think anyone thought that they intentionally did this. It was just an embarrassing cock up that was a nice spot by Gordy... Made my day anyway - I was amused by this.

Probably, yes. If they didn't know they were there, it's hard to delete them before they were told.
Did you mention it to store staff when you saw it, Gordy? Or maybe they saw you taking pictures and wondered why, and found it.
Given that knowingly using illegal copies would probably be criminal, it's hard to argue that they've got to leave the files there, and so commit a crime, in order to avoid deleting evidence.
And anyway, what crime? Unless it can be shown that they were put there deliberately by JL, I can see that it is a crime. Bear in mind that most crimes, excepting strict liability things like drink driving and speeding, require 'intent'. It's the "mens rea" element of most offences.
Anyway, it's all a bit silly anyway, since JL is not the type of company to do this deliberately, or to tolerate it if they knew of it. Nobody, in my opinion, be it the criminal authorities or the rights owner, is really going to be in the slightest but interested, especially if the offending material has been removed.
Or because I contacted their customer service manager, who immediately went to see the department management about it.
I have a lot of time for John Lewis. I've dealt with them a lot, and have had exceptional service from them. We can all have a bit of fun with them and the embarrassment potential of this when there's a goof like this, but at a more serious level, the best thing for both JL and the owners of the IP rights is to get the offending material removed. It has been, I'm assured, and has been raised both with senior branch management and head office.
If they knew which person did it they probably sacked them for gross misconduct.

I didn't mention it as I was in a hurry, I just took 4 pics and carried on through. There was no staff nearby so I doubt they noticed me taking pictures. It was on my mobile so it was a bit more subtle that getting out an SLR too
I'm surprised that John Lewis haven't tried to ask when I took the pictures , because they weren't taken too recently.
I wonder if a message has been sent to other stores to check all machines as well. I had half a mind to go back up and see what was going on, but I've been out most of the day.

First off, great find gordy.
However there is absolutely no way JL would have condoned this, and their response will be the same as any big company that finds anything "wrong" happening within one of their stores. They'll just send and email around to all stores explicitly forbidding the "wrong" thing and that if anyone is found doing it, it will be classed as gross misconduct and they'll face the sack with possible prosecution (depending on how bad it is). This way they can prove they had forbid it and if any problems/legal issues came of it, they could show that it was against company policy to reduce their accountability. Obviously they would also contact the specific store manager incharge and give them a ticking off and find out who was responsible and decide what they want to do to them.
I'm not going to get into what disney/buena vista will probably have to say about it, as you could get quite indepth on that and they probably wont care that much as long as JL promise it wont happen again.
What intrigues me (and someone mentioned it a little earlier) is what the Video Standards Council and Trading Standards would make of it, given that Pirates 2 has a BBFC rating of 12 and if they were showing it before 7pm they were technically breaking the Video Recordings Act, unless of course it was an edited demo copy of the film/trailer version that had been issued a PG BBFC rating (just like how you get trailers in the cinema for 18 horror films but it says the trailer is rated 15 etc... However we already know this is not the case as it's a pirated copy of the film, and i'm going to go out on a limb here and put my money on that axxo wont have submitted it to the BBFC and had it given a lower rating
If it was taken any further there would almost certainly be more of the earlier mentioned emails coming out of the JL head office as they'd have to prove their VSC/VRA training is adequate and often refreshed, then likewise the store managers would have to prove they had passed this training on to the staff properly. And lastly the member of staff that put it on (assuming it wasnt the mananger) would have to give their excuses for not following the training if they were given it.
So the big question is, What time did you take the pics Gordy? and if it was before 7pm who's got the number for Trading Standards? just kidding
