    Contractually agreed terms that state the game will be supplied on it's release date, with a priviso that the release date is beyond the suppliers control. As long as they deliver on, or around the release date as agreed, they're not in breach of contract.


    As I said, it's a question of the T&C's, particularly the section relating to out of stock items. AFAIK, there is a legal provision to complete a contract of sale within 28 days for mail order items but that this priviso only relates after payment has been made, which is of course why you used to see all those mail order adverts in the paper that goods would be shipped within 28 days.

    The bank route imho will be fruitless. The problem is you had authorised someone (ie given them all your details) to take money, unless you claim it was fraud, they won't help you at all. You could ring up and find out what their policy on "in error" transactions is thou, but I think they will tell you its the merchants fault.

    Also on the subject of breach of overdraft fines, the banks were able to demonstrate they make piss all money on them, granted this might be due to their inefficency and a total lack of desire to improve on this front, but when you breach an overdraft they normally end up reviewing your account, this costs money, then there is the big risk factor, which costs a lot of money. Then there is the other problem a bank which says "hey guys we wont charge you if you exceed your agreed credit limit" yes, that sounds like a sound plan doesn't it..... As such they are never going to go softly softly on these fees (which are also often less than some of the payday loan types, but thats a whole different kettle of is it better to have them regulated than have loan sharks fish)

    A very simple way of not having them is to have a large overdraft you don't normally use, my bank had no issue what so ever giving me a months gross earnings as an overdraft. The other thing is if your not clearing your overdraft every month, without fail, then you really must look at your spendings brutally. I was flabberghasted when a friend of mine who'd been moaning about his money woes then bought a new AV receiver which cost almost half the amount of his debt. Don't want to pay a fine, don't behave like a petulant "i want it" child with credit lines. Remember most overdrafts can be taken away with very short notice, so never plan on them being there for more than a month!

    Don't agree with that. It may fail, but it's not a certainty. I recently got a refund on a charge after complaining

    Presumably he's already maxed out the free portion of his overdraft. All of the student accounts have chargeable overdrafts as well as interest free overdrafts as I understand it.

    Banks fall over themselves compteting for student acconts, ecause while thet may be loss leaders now, the chances are that the student, after graduating, will stay with the bank and they will gain in the long term. So there is a better than even chance that they will take notice proded the account has been operated responsibly in the past.

    There is certainly nothing to lose (apart from the cost of a stamp) and everything (well, any charge that is reunded) to gain.
