Been charged for a back order from 4 months ago, advice

    As the title says,

I've been charged for a back order from 4 months ago and the money taken has gone into my overdraft which I assume will charge me £48.

It's from 7dayshop, I got the e-mail this morning and saying that it will be dispatched, I contacted them immediately and they say I will be refunded within 24-48 hours.

I'm well annoyed just now, I'll incur a near £50 charge because a company processed an order which is 4 months old when I assumed it was originally cancelled because there was no stock.

Can I do anything about it?

Get a bank which doesn't suck huge hairy ones? Other than that. Not really. You can never assume an order will be cancelled because the retailer is out of stock, and they're not liable for bank charges, not even as a good will gesture should they be expected to pay for that kind of bank charge.

Ultimately, there's no substitute for being really frugal with your expenditures.

Tricky, ask your bank first, they may waive it as a goodwill gesture, go into a branch though, that tends to get better results than ringing up (which you should do if the branch say no)

Student account, I've just about got round to realising I need to get a hold of better 'financial management'. I'll pop into the bank on Friday.

I'm not sure how long you get to pay it off before a charge is incurred but if it gets refunded quick enough I maybe OK (wishful thinking I know).

you could take the approach they took the money without permission 4 months after the order was placed.

Never assume! Unless they explicitly say the order is cancelled, or you explicitly cancel it, the order will remain open.

If this is the first time you have dipped into your overdraft, the bank is likely to waive the charge, particularly if the refund is in the account when you approach hem, point out it was an error, and that you have done all you can to rectify the situation.

I know, I've only just recently started putting all the bills and stuff in order then this pops up!

I've managed to get my mum to transfer some money across which has taken me out of the overdraft so I'm really hoping I don't get a charge through!

Thanks to all who have replied to far!

Thats why you should go for a low current account, if you dont have the funds in the account then they can't use your card details

Re: Been charged for a back order from 4 months ago, advice

if you have a overdraft limit say £100 and you don't exceed that limit you get charged interest only if you go over or don't have a set overdraft limit then you get charged the £40 plus charges as unauthorised overdraft.
pointless writing a pleading letter to banks anymore since they won the court case they wont budge on the fees anymore, you get a snotty letter back saying "we won so no goodwill haha" or there abouts tried it when missus went into red accidently.
as said above if you place an order anywhere that is out of stock always remember to cancel it after a week or so,you can then reorder it when back in stock and it may be cheaper (occasionaly) also stops them doing this as retailer still sees it as active order if not cancelled

you have a student account, why havent you got an overdraft? Every student account i know has an overdraft limit, mines currently £750 with natwest and the whole point of a student account is for the INTEREST FREE overdraft .

if they charge you, close the account, bound to be other banks around who will take your cash for you.

Perhaps a little shopping around wil find you a better account with lower charges for this kind of thing.

You can argue that the supplier is in breach of contract for failing to supply in a timely fashion and as such they're liable for the charges you've incurred for their breach.

However this strongly depends on their T&C and their policies on back order

Write a complaint letter, give them a chance to do the right thing but frankly unless you can be arsed taking it to court, doubt you'd get the satiafaction. Your bank has zero reaponsibilty to fix it.

how does online pre-ordering work then? especially for things like games with flakey release dates. there must be something legit about it or when GT for example is bumped back by a month you dont have to re-order. and as far i i know nobody makes you re-order f release dates (or in-stock dates.. hmm..) change.
