    There was a woman that was in a similar situation (but I think there was more money involved).

    She told the bank repeatedly that it wasn't her money but they told her it was hers.

    So she spent it.

    And now they want their money back. (And because of the various legalities they can).

    So she's campaigning for corporate responsibility or something. I had a quick look on bbc news and google but I couldn't find anything.

    imho if a bank cocks up they should have to foot the bill. if their empolyees aren't up to the job then thats the bank's fault for employing them in the first place surely...
    I recall a story told to me about a consultant who works both privately and NHS, the bank got ONE digit on his account number wrong and his NHS salary went to some unsuspecting punter within the same bank, this continued over a few years...the only thing about it was that this doctor didn't notice the lack of an extra few grand a year such was his consultancy fee!! in a case like that where the 'victim' fails to realise any lost funds should come to dust as its their responsibility to check, and that this guy didn't...well, says it all really doesn't it!!

    The people at the bank she dealt with were F-wits and not doing a good job
    So she spent it.
    And at that point she commited the 'theft'
    And now they want their money back. (And because of the various legalities they can).
    The organisation is entitled to it's stolen money, she is a thief.
    On the other hand the staf that dealt with her initially are F-wits and should be Disciplined

    On other anecdotes:
    I paid over £500 into my student loan account over a 1 year period.......I realised my F-up and contacted them....
    The money had obviously been going into someone elses account.
    I got my money back no questions asked and presumably the aother account went back into deeper debt.

    I think Skii hit the nail on the head.

    My attitude (morally at least), is that while something might be illegal, I'm certainly not going to lose any sleep over it if it involves sticking one to a bloated corporation.

    Naughty me, I know.

    But the £1,300 probably belongs to some customer and not the bloated corporation...
    So you'd be sticking some person not the BIG BAD MAN,
    It could be a pensioner life savings, funeral money, compensation from an accident, wedding money, cash for an abortion....am I pulling on the heart strings yet?

    As Skii said, the bank would be the one who ended up having to compensate whoever it was. Effectively it's £1300 of the bank's money.

    And yes, all very touching...and I'd agree with you if that were the case.

    So, bank loses money. Bank reclaims money by factoring cost of losses in to things like interest rates for savers and borrowers. Bank happy. Customers screwed. And this is a good idea?

    If it's a customers mistake then they'll be liable until it's resolved not the bank.

    If it's a bank error then you could someone the sack over it....

    Either way the word is immoral....

    In all honesty the morality of keeping the money is wrong, and yes ultimately the cost lies with the customer, but these types of incidents are the kind of thing that happens to maybe a small percentage of us once in a lifetime, not like its an everyday thing for all of us which when abused drives up the cost for everyone else (like insurance for instance)

    Far more significant amounts of cash are swallowed up in Fat-cat Executive salaries, pay hikes, golden handshakes etc etc. Quite honestly the practices of many banks leave a lot to be desired and when occasionally an individual accidentally profits from their mistakes, I say good luck to them.

    The interest gained by savers is a drop in the ocean against the real interest earned by the banks investments. Those investments are done with the money that you and I plough in on a weekly/monthly basis. That and the cumulative effect of said investments. So other savers or account holders suffering as a result of a kneejerk reaction from the banks against the amounts that goes missing due to such errors is not much of an argument.

    As monopoly always says:
    "Bank error in your favour, collect £20"
    1300 - 20 = £1280
    Therefore you you take all your money out of that account, and leave £1280 in it, and if the bank ever try and get it back or anything then just show them the monopoly card and tell them that they can't break the rules.

    Take it. Its the banks fault and they can't take it off you. The guy who is down £1300 will be refunded, in fact he most likely already has.

    But they can tale it back and they probably will if they notice. Tough one to call but the best thing is just to sit on it, play it by ear for a while. Leave the money in the account and see what happens.
