    Leagle Eagle needed

    Does anybody have experience of taking a company to the small claims court. I believe I have an incredibly good claim, but would like a bit of advice re procedure as I want to take a major high street shop to court.

    It's 14 years since I got my law degree, so that's probably not much help to you, but

    Well....a manager has just called me and promised me the world....I am still dubious, but have given him one more day....it is actually so bad it is funny = I will elaborate tomorrow if not sorted!

    It's a long story.....

    ...but as you ask....

    Bought a cooker and hob on May 25th...paid for installation.

    Time off work for delivery.

    Time of work for installation.

    Engineer turns up...takes one look at hob and says...I can't fit that as I am not CORGI registered. Hob also needs extra piping as current piping although legal when fitted is not now legal so needs replacing.

    However it is also the case that even if the extra work was not needed he could not have done it as he nobody told him it involved GAS.

    I get straight on the phone whilst he is still in house....get fobbed off saying ring this number...ring this number etc etc.

    Whilst doing this and still on phone, he leaves saying all is OK with the oven.

    I then try to cook pizza in oven. 12 minute pizza takes 45 minutes....hmmm something is wrong.

    Look in oven...it is fan assisted..unfortunately the great big fan at the rear of the oven is not physically connected to the oven.

    I then look at T&Cs re fitting. They state that fititng includes the engineer fully testing the appliance in front of customer....it was not.

    I ring company. They say that they will have to send engineer to see whether . I try to tell them that this is a waste of time cos fault is so obvious.

    They want to send an engineer on one day, deliver replacement on another, and send a fitter on a third day. These must be all during the week - no evenings or weekends = 3 spells off work.

    Then follows numerous phone calls at my expense. It is eventually agreed that they will replace cooker without it being tested and an engineer will come and fit both items at no extra charge. The engineer will contact me in advance to sort out a date.

    The engineer did not contact me, but the oven was delivered. I rang to get a date for the engineer. I was told that somehow they had not been contacted. They would fax them and the engineers would contact me ASAP. I phoned them on the way to the supermarket. I did not want to walk round the supermarket speaking to them, so asked for a call back. I was told that they had no facility to call customers back - I found this odd as I had been called back on numerous occassions by them. I was also assured that the engineers had contacted the company stating that they would contact me today.

    Hmmm....they failed to contact me so I called back...it took half an hour to go through the record to get the person I was speaking to up to date with what had happened. He said he would call me back after speaking to the engineers (there had obviously been a software/hardware update to allow him to do this). He called me back and told me that the engineers had no record of my order.

    Ok so at this point I was really in a bad mood, but eventually got a fitting date earlier this week. I was assured by three members of staff that the company coming to fit the hob and oven were fully aware of the situation and would fit it all at no extra charge.

    So on monday two engineers turn up....one for the oven, and one for the hob. The hob man takes one look and says that nobody told him that there was extra piping to be fitted and said he could not do it.

    Right.....I am livid now and a phone call goes in.....this is when I get really mad!

    I speak to somebody who calls me back. She says that I was refunded £40 for the fitting of the hob, and it was never the case that I was getting the hob fitted. I turns out I was refunded £40 but not by my choice. She claimed that this was always the situation. So why did she not know about this when I called her. Why did 3 people confirm that engineers were coming to fit my hob? And why did a gas engineer turn up to my house if they were only fitting the electric oven. They obviously just saw th refund and tried to have me over.

    Anyway...it took over a month to fit the oven. In the meantime I had no oven at all. I have lost track of how many days I have waited for deliveries/fittings/collections, and the hob is still in its box.

    There latest offer is get the hob fitted privately and send us the bill.....but this is only verbal.

    Bet you wished you didn't ask now!

    Nice - I'd have said I wasn't satisfied and ask for a full refund and have gone somewhere else about half way through that, lol.

    The problem was the amount of really convincing people who assured me that they had taken responsibility for my case and would have it sorted ASAP....

    anyway...do you reckon there is a case for the small claims court?

    Hmmm

    I see Slough customer service is at its usual high standards.

    Unfortunately in these situations the messed around customer usually doesn't have a leg to stand on, Unless they made a contractual agreement when you placed the order with them, and they broke the terms of that contract, (which you can then prove) then you've got them.

    Being hugely inconvenienced usually isn't enough unfortunately - good luck with it anyway m8

    failing that apply large, heavy, high velocity object to face of those who sold said cooker etc. to you and exact your revenge by way of their necessity of having to take a few days/weeks/months off work whilst recovering in hospital...
