    Plusnet Users - Important

    You may have seen serveral threads (sorry for another) on this and probably other forums concerning Plusnets weasly approach to "making the broadband experience better" by introducing caps and throttling things like peer to peer.

    If like me you thought you were getting an uncapped, and again like me a premium contention service when you joined only to recently find out that no, if Plusnet want to change their T&C's its fine. Also if you want to leave the aforementioned uncapped (now capped) premium contention (throttled) service you have to pay them for the pleasure

    What I want people to do is to open a customer service issue ticket thing with them and at every opportunity complain about the service they offer and the changing of the T&C's. In fact can someone come up with a stonking standard response that we can all use? Also to never close this ticket but leave it opened so that they have all these unsatified customer queries clogging their service that go on and on...... by adding to it continually so that every response states you are unhappy with their service.

    We might just get them to either lets us go or maybe force some sort of change?

    I think the standard letter should mention:

    Until previously they openly advertised as uncapped plus premium

    The way the internet is changin with video on demand etc

    Finally that they are total retards that think being miserly and not buying usage is okay as long as they shaft their users and tell them its for the benefit of everyone

    Anyone think of anything else?

    Only thing I can think of is that,

    Its not the best idea in the world.

    Personally I dont think you would get enough people to do this and PN customer support is Open 24/7 I am sure the have enough staff to sort out a few annoying tickets.
    Ofcourse you could make sure you are around 24/7 to keep those tickets alive.

    Sounds like a lot of hassle to me.
    An easy option would be to have torrents on 24/7 for 3months untill they get fed up and kick you off

    I have already posted 2 unhappy tickets.......i also sent them a link to the threads on the hexus forum.

    They said that this was a small percentage and at they have not advertised unlimited products for over a year!

    They dont really care tbh!!!!!!

    They just severly throttle your whole account if you do that.

    Also a ticket will be actioned but you have to state if it was satisfactorly resolved

    I'm going to put this on other forums and pass it to freinds whom I reccommended to join plusnet

    Okay here is what I'm going to send them on a daily basis and I'm also going to send it recorded delivery asking for a response within seven days:

    Dear Plusnet

    On the 21st of June 2005, I agreed to an uncapped premium contention broadband service for £21.99 per month for which I now have several complaints:
    The complaints are:

    1. This service is now capped

    2. The service is now prioritized therefore in my view as the consumer is no longer the premium service I agreed to.

    3. The change to you Terms and Conditions by way of email on 29/08/05 was misleading under the Unfair Terms in Consumer Contracts Regulations were the email does not mention in the summary of changes my service will now be capped and regulated.

    As a consumer, I am protected against unfair standard terms in contracts by the Unfair Terms in Consumer Contracts Regulations (UTCCRs).

    The UTCCRs protect me from terms that reduce my statutory or common law rights, and from terms that seek to impose unfair burdens on me over and above the ordinary rules of law.

    An unfair term in a contract covered by the UTCCRs is not binding on me.

    A term is unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations under the contract, to the detriment me the consumer.

    'Good faith' means that Plusnet must deal fairly and openly with me.

    Although standard terms may be drafted to protect commercial needs, they must also take account of my interests and rights by going no further than is necessary to protect those legitimate commercial interests.

    According to the UTCCRs, a standard term must be expressed in plain and intelligible language. A term is open to challenge if it has put me at a disadvantage because I am not clear about its meaning - even if its meaning could be worked out by a lawyer. If there is doubt as to what a term means, the meaning most favourable to the consumer will apply.

    I now therefore wish to reject the service you supply and be issued with my MAC key at no extra cost or be subject to cancellation or deferment fees.

    I've giving my 1 month notice and the account should be closed by the 6th/7th of March, and I'll be paying the £47 deffered activation fee :/

    As for what ISP to join - I'm going to take my time deciding and going through the T&Cs in detail before joining up again. I'm thinking of Pipex/Nildram, what do you guys recommend?

    I want 2MB minimum, with at least 150GB/month, uncapped - with none of this peak/off peak crap...ideas?

    I too in the future will alway read all T&C's and will folow up any email in full - I don't like the sneakyness of it all with Plusnet though theri turnaround was despicable.

    I will probably go with Zen 2MB totally uncapped and un-monitored, it seem you only get what you pay for though at £30 per month.

    Oh and after raising the last ticket with the above I got no quick reply but only... investigating! so maybe worthwhile sending this out around other forums etc.

    Hey guys i got my mac code of plus net for free. They were trying to charge me fee's but my cousin (who is training to be a lawyer) sent them a recorded delivery letter. Now they have sent me my MAC code and charged me nothing

    I am moving to Zen. its 34.99 a month but you get what you pay for. It has no cap at all.

    Hey guys,

    Another point of view....

    In August/September time, Plusnet made changes to their T&C's and sent out and email to everyone - giving them 14 days notice to refuse them or if nothing was heard they would be automatically accepted on your part.

    I too signed up with them due to the 'unlimited' nature of the 'Premier' package. This as stated has changed and were now capped (but not capped - SUP they say - now I'm confused).

    I monitored my usage and I was under the new regime's limits. Fine by me, due to referrals I'm paying next to nothing anyway - I can live with that.

    PN have now 'shaped' P2P and Newsgroup access over certain limits so you cant get your 'questionable' content all the time at the max speed the line will go. Anyways this is another discussion - so no flames please....

    Unfortunately I will no longer recommend Plusnet to anyone due to confusing caps (that aren't caps...), all the traffic shaping and the misleading advertising - free modem & activation - but only after 5 years with us - leave early and you have to pay....

    But all the above taken into consideration, take one step back and forget PN for a second. Wheres broadband headed? With faster speeds being available to consumers - it takes less and less 'bandwitch hogs' to take the capacity of the isps's pipes. I'm afraid your going to see traffic shaping widespread over the next few years over most if not all isps.

    P2P/Usenet and other very high bandwidth applications (there are exceptions before you bite my head off - Sky Over Broadband etc) will be heavily traffic shaped to keep web pages/email gaming and VOIP etc all running at high speed. As a gamer, who occasionally downloads stuff - I want low pings, as the bandwidth I use is tiny compared to P2P etc - I can wait as long as it takes, to download whatever I want to download, if its a large file/s - I'll just leave my pc on overnight/schedule.

    Broadband is evolving, the heavy users WILL have to pay if they want to use there connections heavily all the time ala Zen, but the majority of users will see benefit in prioritising traffic as the speeds get higher.

    Back to PN, the customer service went down but has gone better over the last year, its just a shame they're now just another ISP in the long list - without the great rep they used to have.

    On a side note, if the PN caps (that aren't caps) affect me, I'll just change ISP - dont care too much what I pay as long as I get the service (High speed downloads/low pings/good customer service).
