    Yeah thats fair enough. But what I am saying is you bought it from the shop.

    I bought it online, I paid for postage, if it was within the 28 days then I wouldn't have to pay, but it was so I did.

    You bought it from a shop, it was faulty, so you have to take it back. Scan is not in control regarding how far you live from the shop.

    This is where its debatable if you read my posts when you buy through Q-Collect you actually order online & pay online, so in fact I did buy online not from the shop.

    As you had face to face contact with Scan, I wouldn't think the DSR would come into effect (Im more than happy to be proved wrong though )

    Who pays for returning the goods if the consumer cancels
    an order?

    3.55
    If you want the consumer to return the goods and to pay for that
    return, you must make it clear in the contract and as part of the
    required written information – see paragraph 3.10. If the consumer
    then fails to return the goods, or sends them at your expense, you
    can charge them the direct cost to you of the return
    , even if you
    have already refunded the consumer’s money. You are not allowed
    to make any further charges, such as a restocking charge or an
    administration charge.

    3. you are responsible for the cost of returning the goods to us at the address given above
    So even if you were to invoke the DSR, you would still be liable to pay the fee im afraid.

    I know it looks like im trying to stick up for Scan here, but im just trying to give a balanced viewpoint. The cost of delivery if you paid it would have included the fee for a possible return. Surely you have still saved more by collecting it and sending it back via paying yourself though than paying for P&P in the first place?

    Argos as an example have an Online reserve feature were you pickup in store, you also return to the store if an item is faulty.

    It is all about the way the contract was concluded and by collecting your goods from store the contract is not concluded as a mail order sale but a store purchase.
