    Re: New Monitor Advice

Thats not right. The buttom second from left should open the menu. The middle is for the power and then the rest are just relating to the menu. If you press the second from left and the far right button it should bring up a menu with the panel the monitor is using.

Ouch! Mine all work flawlessly :S I guess you got the bad end of the stick? I'd probably play around with it trying to get it to work, otherwise i'd RMA it.

the only trouble i'm going to have with RMAing it is that i don't have the logo on it
(but it was partially off when i got it)

Lmao. I'm sure you can just stick it back on with some sort of adhesive. They won't know. Then you can claim the logo was out of place when you got it too, another reason to RMA

i've contacted yuraku about an RMA, misco told me to do it through yuraku
well part of the logo was already off, the square bit was in the bottom of the box, but me wiping it took all the letters off so technically most of the logo wasn't there to begin with so...

i'll just have to see what they say

That isn't right - see the Sale of Goods Act:

Sale of Goods Act Quick Facts - BERR

    • It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.
Misco are trying to sidestep not only you, but the law.

    Yes, and no.

It is certainly the case that the buyer (and I'm talking about domestic buyer, as it's a bit different for business buyers) has a variety of protections under a variety of legislation, with the Sale of Goods Act being central. It's also true that goods that don't conform to contract are covered by that, and it's the seller not the manufacturer that is responsible, and that they cannot delegate that.

However .... your Sale of Goods Act rights aren't the only way to pursue claims, and dependent on circumstances, aren't necessarily the best way.

First off, if the goods were ordered and delivered recently, the best approach might be to reject them under the Distance Selling Regs AND the Sale of Goods Act. If they genuinely don't conform to contract and you have a case to reject them under the SoGA, then you can reject them under the DSR and don't have to pay the cost of returning them.

But secondly, and perhaps more relevantly, it's not always best to stand on your legal rights. If you reject goods as not conforming to contract, there's always the possibility that the seller won't accept that they don't and, ultimately, that can lead to a court case to decide who is right.

So .... while a retailer can't (legally) refuse to honour their statutory obligations, they can point out that there might be a better route to take, such as relying on a manufacturer warranty. After all, if the manufacturer offers a decent warranty (such as on-site service or swap-out by courier exchange), that might be the best way of resolving the issue. And if you send goods back as not conforming with contract, it may be that the retailer decides to get a third-party opinion on the nature of the alleged non-compliance, such as by sending them back to the manufacturer. And if they do, it may be quicker to get them picked up by the manufacturer.

So yes you're right, the retailer can't refuse to honour their duties (or at least, not without risking ending up in court, they can't) BUT they can suggest alternative options, and people need to bear in mind that their Sale of Goods Act rights can be a little less beneficial than many people think they are.

    Re: New Monitor Advice

Also TAKTAK, Misco's markup on that monitor is probably very small and Im guessing they dont want to shell out for the carriage costs to pick that one up and ship another to you, so in the hope to save money they've told you to goto the manufacturer!

Personally if I had a 3 day old monitor that was faulty I would be dealing directly with Misco not the manufacturer, tell em its not on! (you can always cancel the RMA with Yuraku once Misco pick up the RMA).

Hope you get it sorted soon

    Re: New Monitor Advice

    All's well that ends well

The reason Eizos cost so much isn't so much to do with the panel - those monitors surely have very high levels of QC, have very even back-lighting (check yours by viewing a solid gray background in a darkened room), utilise the best internal image processing kit, and require negligible calibration out of the box.

Fortunately, the rest of us poor folk can get 90% of the performance with a lesser monitor using the same panel and a calibrator. As in all things technological, it's those last few percent that double or triple the price...
