    While statutory rights always overrule an EULA, software isn't as strongly protected under the regs as physical products - there's no distance selling cover once you've accepted the contract and opened the packaging for example. Fit for purpose Sales of Goods Act still applies, however that's not an assessment on the quality of the game, but if you can prove that it doesn't run and it's not anything related to your specific set up then you're okay (good luck - they will usually be able to prove that it does run on generic computers meeting the spec).

    But once again, look at what I've been hinting at very strongly. You're not buying a retail product with Steam. You are subscribing to a game provision service. If they have provided you with the game correctly then you've got the service that you paid for.

    So what's not illegal is legal?
    Yeah, I don't think anyone suggested otherwise

    But as I said, "or a portion of it". I don't know of any case where the entire EULA has been nullified due to one clause being overturned (be interesting to know if there is one though! )

    There isn't, but it was just the wording you used when you said:

    Which could semantically be taken as you also saying when a court says a portion of the EULA is invalid the whole EULA is invalid, which would be wrong. But from your reply that's not what you're saying (you just needed to repeat the portion bit for the invalidness)

    Steam did give refunds for GTA 4 at one point in time,

    So it's worth asking, on the other hand it was a fiver and it should work well enough.

    I know all about the problem as I bought it retail when it came out - luckily HMV vouchers but still not worth it for anymore than a tenner due to the horrific performance and stability.
