Windows Vista and windows 7 "legally" gives you up to 120 days trial out of the box.

If you pre-order then you're buying the right to use the software from October 22nd, not before.
If I pre-pay to rent a Ferrari arriving on October 22nd I'm not legally able to steal a different one from the factory and use it before that date
